Winning Back Protections for Refugee Survivors: Celebrating the End of Matter of A-B-

(June 24, 2021) - Last week we celebrated a major victory for refugee women and families. On June 16 Attorney General Garland vacated Matter of A-B- and other Trump-era Justice Department rulings that attempted to shut the door on people escaping domestic violence, gang brutality, and other human rights violations. 

This life-saving move by Garland was the culmination of years of hard-fought litigation and advocacy. It took every tool we had in our toolbox, and it took all of us. 

Since the spring of 2018, CGRS has been fighting for our courageous client Ms. A.B. – whose case was exploited by the Trump administration in Matter of A-B-, and who has now spent seven years in anguishing legal limbo. 

With the negative ruling in her case overturned, she feels profound relief. “I feel content and happy that my case can help other women who are going through the same thing I am," Ms. A.B. says.

Over the years we've had the privilege of working with incredible attorneys and advocates to creatively challenge Matter of A-B- in the courts. With our partners at the ACLU, we stopped the government from using the ruling to reject asylum seekers in initial border screenings.

Through our technical assistance and training programs, we supported advocates fighting for their clients in an increasingly hostile court system. Our appellate litigation efforts resulted in precedential victories in multiple federal circuits. Our movement beat the odds time and time again.

And we took our advocacy outside the courtroom, too. Immigrant and women's rights advocates and activists came together to hold our leaders accountable at all levels of government. Immigrant women bravely shared their stories and demanded justice for their communities. We raised our voices, and we made sure justice for refugee survivors became part of every Democratic presidential candidate's immigration agenda.

When the new administration took office, our movement kept the pressure up and held President Biden accountable to his campaign promises. Hundreds of organizations, advocates, and asylum seekers called on the Attorney General to do the right thing.

What does this victory mean for people seeking asylum? Our partner Leticia, an asylum seeker and member leader with Mujeres Unidas y Activas, put it this way: “This decision gives hope to people fleeing domestic violence and gives us the chance of obtaining asylum. I feel like God is giving me another chance.”

That is what this fight has been about. Saving lives.

There's still a long road ahead. Attorneys, activists, and asylum seekers are coming together in an unprecedented way to advocate for a better system, one that welcomes people escaping persecution with dignity.

This victory energizes us and reminds us that, when we work together, we can deliver safety and justice for refugees.

Recuperando protecciones para sobrevivientes refugiadas: celebrando el fin de Asunto de A-B-

(24 de junio de 2021) - La semana pasada celebramos una gran victoria para las mujeres y familias refugiadas. El 16 de junio, el fiscal general Garland anuló Asunto de A-B y otras decisiones emitidas por el Departamento de Justicia de la era Trump que intentaron cerrarles las puertas a las personas que escapan de la violencia doméstica, la brutalidad de las pandillas y otras violaciones de derechos humanos.

Las acciones tomadas por Garland salvarán vidas y representan la culminación de duros años de litigios e incidencia. Se necesitaron todas las herramientas que teníamos en nuestra caja de herramientas y fue un esfuerzo colectivo.

 Desde la primavera de 2018, CGRS ha estado luchando por nuestra valiente cliente, la Sra. A.B. - cuyo caso fue explotado por la administración Trump en Asunto de A-B-, y quien ha pasado siete años en un angustioso limbo legal.

La revocatoria de la decisión negativa en su caso le trajo un profundo alivio. “Me siento contenta y feliz de que mi caso pueda ayudar a otras mujeres que están pasando por lo mismo que yo”, dice la Sra. A.B.

A lo largo de los años, hemos tenido el privilegio de trabajar con abogados y defensores increíbles para retar creativamente la legalidad de Asunto A-B- en los tribunales. De la mano de organizaciones aliadas, como ACLU, impedimos que el gobierno utilizara la decisión para rechazar a los solicitantes de asilo en las evaluaciones fronterizas iniciales.

A través de nuestros programas de capacitación y asistencia técnica, apoyamos a los defensores que luchan por sus clientes en un sistema judicial cada vez más hostil. Nuestros esfuerzos de litigio a través de apelaciones resultaron en victorias que establecieron precedentes positivos  en múltiples circuitos federales. Nuestro movimiento superó las probabilidades una y otra vez.

Y nuestra incidencia también se dio fuera de las cortes. Defensores y activistas de los derechos de las mujeres e inmigrantes se unieron para hacer que nuestros líderes respondieran en todos los niveles del gobierno. Mujeres inmigrantes compartieron valientemente sus historias y exigieron justicia para sus comunidades. Alzamos nuestras voces y nos aseguramos de que la justicia para las sobrevivientes refugiadas se convirtiera en parte de la agenda migratoria de todos los candidatos presidenciales demócratas.

Cuando la nueva administración asumió el mando, nuestro movimiento mantuvo la presión para que el presidente Biden cumpliera las promesas que hizo durante la campaña. Cientos de organizaciones, defensores y solicitantes de asilo pidieron al Fiscal General que hiciera lo correcto.

¿Qué significa esta victoria para las personas que buscan asilo? Leticia, solicitante de asilo y miembro líder de nuestra organización aliada Mujeres Unidas y Activas, lo expresó de esta manera: “Esta decisión da esperanza a las personas que huyen de la violencia doméstica y nos da la oportunidad de obtener asilo. Siento que Dios me está dando otra oportunidad".

De eso se ha tratado esta lucha. De salvar vidas.

Aún queda un largo camino por recorrer. Abogados, activistas y solicitantes de asilo se están uniendo de una manera sin precedentes para abogar por un mejor sistema, uno que reciba con dignidad a las personas que escapan de la persecución.

Esta victoria nos da energía y nos recuerda que, cuando trabajamos juntos, podemos brindar seguridad y justicia a los refugiados.
