Yesterday the Supreme Court granted the Trump Administration’s request for a stay in Innovation Law Lab v. Wolf, allowing the government’s so-called Migrant Protection Protocols (MPP) to remain in effect while the court decides whether to review the case.

Last month the Ninth Circuit Court of Appeals ruled that MPP violates both U.S. and international law and restored a previous district court injunction against the policy, which to date has resulted in the forced return of over 60,000 asylum seekers to perilous conditions in Mexico.

The Center for Gender & Refugee Studies (CGRS), American Civil Liberties Union, and Southern Poverty Law Center brought the Innovation Law Lab lawsuit when the Trump Administration launched MPP last year. CGRS Legal Director Blaine Bookey had this to say about the Supreme Court’s ruling:

“Two federal courts have now found MPP to be clearly unlawful, and likely to result in irreparable harm to our plaintiffs. As the Supreme Court considers weighing in, the policy will unfortunately continue to place asylum seekers directly in harm’s way. We will continue to fight for an end to MPP and are hopeful that the court will ultimately reinstate the injunction against this dangerous and illegal policy.”
