Case Summary

The IJ denied deferral under CAT to a Mexican former cartel member who became an FBI and DEA informant and testified publicly against several police officers on trial for corruption and other crimes in N.D. Cal. The IJ found him ineligible for asylum and 241 withholding and denied CAT deferral because there was insufficient evidence of future torture and acquiescence. The BIA denied the appeal and also denied the motion to remand because the new expert report was not previously unavailable. The attorney is moving for reconsideration and going to petition the 5th Circuit for review.
