Case Summary

The immigration judge granted withholding of removal to a Salvadoran female applicant who fled gang violence. After a prior removal from the United States, she was raped and "claimed" by a gang leader in El Salvador. According to the applicant's attorney, she was later prosecuted in the United States for illegal re-entry and found to be barred from asylum. However, an IJ reversed an earlier negative credible fear determination based on a lack of nexus, and another IJ granted withholding of removal based on the applicant's rape and a finding that the gang is the de facto government in rural El Salvador, according to the applicant's attorney.
