Case Summary

The asylum office granted the asylum claim of a Venezuelan man who was threatened and attacked, along with his sister, after challenging a taking of his family's land. The family owned land on which they were planning construction; however, the Venezuelan government built a housing settlement on the land with no notice to applicant's family. When discovered, the family filed complaints with the government. When the family returned to investigate the settlement more they were threatened. Applicant and his sister were then also subsequently attacked, requiring medical treatment; the attackers made reference to applicant's political beliefs during the assault. Applicant and his family pursued criminal charges against their attackers, but the prosecutor was unwilling to pursue the case. The applicant's attorney reported that the case was primarily based on political opinion.
